Welcome to Smart Industrial! As an employee, you have certain rights and protections under Australian law, including the Fair Work Act 2009. This Fair Work Information Statement provides an overview of your entitlements and where to find more detailed information.

National Employment Standards (NES)

The National Employment Standards (NES) are a set of 11 minimum standards that apply to all employees covered by the national workplace relations system. These standards cannot be overridden by any other agreements or arrangements.

The NES includes:

  • Maximum weekly hours of work (38 hours, plus reasonable additional hours)
  • Requests for flexible working arrangements
  • Parental leave and related entitlements
  • Annual leave
  • Personal/carer’s leave, compassionate leave, and family and domestic violence leave
  • Community service leave
  • Long service leave
  • Public holidays
  • Notice of termination and redundancy pay
  • Fair Work Information Statement provision
  • Casual Employment Information Statement provision you choose to provide in your communication with us

Awards and Agreements

Your employment with Smart Industrial may be governed by a relevant award, enterprise agreement, or other registered agreement. Awards and agreements set out additional employment terms, including pay rates, conditions, and classifications. Smart Industrial will provide you with a copy of any applicable award or agreement, or you can access it via the Fair Work Ombudsman website.

Pay and Entitlements

You are entitled to receive at least the minimum pay rates for your classification under the relevant award or agreement, including allowances, penalty rates, and overtime, where applicable. Pay rates are reviewed annually by the Fair Work Commission.

Workplace Health and Safety (WHS)

Your health and safety in the workplace are important to us. Smart Industrial is committed to providing a safe work environment in line with WHS laws. You are expected to comply with our WHS policies and procedures and report any hazards, incidents, or injuries immediately.

Protection from Unlawful Termination and Workplace Rights

The Fair Work Act provides protections against:

  • Unlawful dismissal, including dismissal based on discriminatory reasons
  • Adverse action, such as being treated unfairly for exercising a workplace right (e.g., joining a union)
  • Bullying, harassment, and discrimination in the workplace

If you believe you have been unfairly treated or dismissed, you can seek assistance from the Fair Work Ombudsman or, in some cases, the Fair Work Commission.

Workplace Bullying and Harassment

Smart Industrial is committed to providing a workplace free from bullying and harassment. Employees who experience or witness bullying or harassment should report it immediately to their manager or the designated contact person within the company. All complaints will be treated seriously and handled confidentially.

Union Membership and Representation

You have the right to join or not join a union. Unions can represent employees in negotiations and assist with workplace issues. Smart Industrial respects your right to be represented by a union if you choose to do so.

Casual Employees

If you are a casual employee, you may have entitlements under the NES, including the right to request conversion to permanent employment after meeting specific conditions. You will also receive a Casual Employment Information Statement outlining your rights and conditions as a casual worker.
